Employment liability: Know the risks
Employee claims of harassment, discrimination, or wrongful
termination are growing rapidly, affecting small and large employers alike. Employment claims
can allege:
- Harassment, including sexual harassment;
- Discrimination: Race, color, religion, gender, pregnancy, marital status, national
origin/ancestry, age, disability/handicap, veteran status, citizenship;
- Wrongful termination, such as breach of employment contract or other forms of unfair
dismissal, including constructive discharge and deprivation of career opportunity
by failure to promote;
- Retaliation because of a legally protected act, like complaining about discrimination
or filing for workers' compensation benefits.
- Employment-related incidents such as infliction of emotional distress or defamation.
